Measures subject to employee participation
The staff council has a right to co-determination regarding personnel, organizational, social, and other internal measures.
The decision must be communicated to the agency within two weeks.
Measures subject to co-determination include, in particular:
- Hiring
- Terminations
- promotions
- Pay grade classifications
- Rejection of requests to participate in telework or mobile work
- Waiver of competitive selection
- Conclusion and amendment of employment agreements
- Duration, start, and end of the daily workday, including breaks
- Assignment of additional work and overtime
- Assignment of on-call duty
- Appointment of company physicians, safety officers, first-aid officers, etc.
- Organizational charts and changes thereto
- Regulations governing order in the workplace and the conduct of employees
- Determination of the content of performance evaluation guidelines
- Introduction, significant expansion, and use of technical devices designed to monitor employees’ behavior or performance
