Measures subject to employee participation

The staff council has a right to co-determination regarding personnel, organizational, social, and other internal measures.
The decision must be communicated to the agency within two weeks.

Measures subject to co-determination include, in particular:

  • Hiring
  • Terminations
  • promotions
  • Pay grade classifications
  • Rejection of requests to participate in telework or mobile work
  • Waiver of competitive selection
  • Conclusion and amendment of employment agreements
  • Duration, start, and end of the daily workday, including breaks
  • Assignment of additional work and overtime
  • Assignment of on-call duty
  • Appointment of company physicians, safety officers, first-aid officers, etc.
  • Organizational charts and changes thereto
  • Regulations governing order in the workplace and the conduct of employees
  • Determination of the content of performance evaluation guidelines
  • Introduction, significant expansion, and use of technical devices designed to monitor employees’ behavior or performance
